These Terms and Conditions govern the contractual relationship between DRIVE ME BARCELONA S.L., with its registered office at Calle Escoles, 19, Sant Jaume dels Domenys, 43713 Tarragona, and Tax ID number B-55649859 (hereinafter, “the Lessor“), and the customer (hereinafter, “the Lessee“), under which the Lessor grants the Lessee the use of a vehicle under the terms, price, and other provisions established in the corresponding rental agreement.
The Terms and Conditions, together with the Privacy Policy, constitute the complete agreement that governs the provision of services by the Lessor. By contracting the services, whether through the digital platform Drivemebarcelona.com or in person at the office located at Calle del Dr. Aiguader, 5-7, 08003 Barcelona, the Lessee acknowledges having read, understood, and fully accepted the provisions contained in these Terms and Conditions.
The Lessor reserves the right to modify, update, or interpret the Terms and Conditions at any time. Therefore, the Lessee is advised to review them periodically to stay informed of any changes that may affect the contracted services.
1. Applicable legal framework
The legal framework governing these Terms and Conditions is established by the relevant laws and regulations that apply to the rental of vehicles and the protection of consumers and users. This includes, but is not limited to, the Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, as amended by subsequent legislation such as Law 3/2014, of March 27, and Law 44/2006, of December 29, which are aimed at strengthening consumer rights protection.
Additionally, the regional legislation applicable in the territory where the service is provided will also apply, along with any future laws that repeal, complement, or modify the aforementioned legal provisions.
2. Vehicle Use Policy
The Lessee agrees to comply at all times with the traffic and circulation regulations in effect at the location and time of vehicle use. In the event of a violation by the Lessee, the Lessor is legally obligated to provide the Lessee’s details to the competent authorities in accordance with applicable regulations.
It is mandatory for the Lessee to carry a valid copy of the rental agreement at all times during its term. Failure to present this document may result in fines or other legal implications.
The services offered under the modalities of Barcelona City Tours, Road Routes, Experience Packs, Trackdays, and Custom Events are services framed within a vehicle rental contract. Each of these services is part of a vehicle rental with a specific duration and route, always under the supervision of the Lessor’s staff.
For the transportation of minors who are 135 cm or shorter, the Lessee is required to use approved child restraint systems that are appropriate for the child’s characteristics. These devices may be provided by the Lessor for an additional fee. However, the Lessor will not assume any responsibility for personal or material damages, direct or indirect, arising from the installation, improper use, or failure to verify the child restraint system by the Lessee.
In adverse weather conditions that could endanger driving or cause damage to the vehicle, the Lessor reserves the right to cancel the reservation or withdraw the vehicle from the Lessee.
The specific vehicle use policies for the different service modalities offered are outlined below:
2.1 City Tours, Road Routes and Experience Packs
The Lessee must be over 21 years old and hold a driving license with at least two years of experience. If the Lessee does not meet this requirement, they may participate as a co-driver while a member of the Lessor’s staff drives the vehicle.
It is mandatory to present two forms of original identification: the driving license and either a passport or NIE. Lessees from countries such as Saudi Arabia, Australia, Canada, the United States, India, Japan, New Zealand, Turkey, and others not adhering to the Vienna Convention must also present a valid international driving license (internationaldriversassociation.com).
To participate in the experience, the Lessee must pay for the vehicle insurance, which is non-refundable. Alternatively, the driver may choose to pay a security deposit of 1,000€, which will be blocked on their card during the activity and released at the end, once the Lessor’s staff inspects the vehicle and confirms there are no damages.
Drivers from countries where driving is on the right-hand side of the road (such as the United Kingdom, Ireland, Japan, Australia, among others) must pay a mandatory deposit of 1,000€, under the same blocking and unblocking conditions.
Participants must arrive at least 15 minutes in advance to sign the required documentation and complete the verification process before the activity begins.
During the experience, a bilingual professional instructor will accompany the Lessee in the front seat, providing assistance and guidance at all times. If desired, the Lessee can hire a lead car for an additional cost, which will lead the route and maintain constant communication with the Lessee through a walkie-talkie system. It is mandatory to follow the instructor’s instructions; failure to do so may result in the immediate termination of the activity and the imposition of a 100€ penalty.
Any medical condition or disability that may affect the activity must be disclosed at the time of booking. Conditions such as epilepsy, heart, or respiratory problems must be communicated before the experience begins.
Participants who are shorter than 1.50 meters, taller than 1.95 meters (approximately between 5′ and 6′7″), or who weigh more than 120 kg may have difficulty fitting into the vehicle. The Lessor’s staff will check comfort before the activity begins. If these difficulties compromise safety, the option to participate as a co-driver will be offered, or a full refund for the activity will be provided.
2.2 Hourly or Daily Rentals
The Lessee must be over 25 years old, hold a valid driving license with a minimum of two years of experience, and present two original identification documents: the driving license and either a passport or NIE. Additionally, Lessees from countries not adhering to the Vienna Convention, such as Saudi Arabia, Australia, Canada, the United States, India, Japan, New Zealand, or Turkey, must have a valid international driving license (internationaldriversassociation.com).
The vehicle may only be driven by the primary driver who has signed the rental agreement, unless an additional driver has been registered in the corresponding section of the rental contract. In that case, the additional driver must meet the same age, license, and documentation requirements.
To formalize the rental, the Lessee must make a security deposit as a bond via credit card, with an amount ranging from 2,000€ to 9,000€, depending on the model of the rented vehicle. It is the Lessee’s responsibility to ensure that their credit card has the necessary balance for this transaction. Otherwise, the Lessor will not deliver the vehicle and will retain up to one day of the pre-paid rental amount as a penalty. The security deposit will be refunded within 24 to 72 hours after the vehicle has been inspected by a member of the Lessor’s staff, provided that no damages or defects are detected.
The rental agreement sets a maximum mileage limit that the Lessee can travel, determined by the duration of the contracted period. The mileage limits are as follows: (2h – 60 km), (4h – 80 km), (6h – 100 km), (8h – 120 km), (12h – 150 km), (1d – 200 km), (3d – 570 km), (5d – 900 km), (7d – 1190 km), (14d – 2240 km), (28d – 4340 km). For discounted rates of 50% or more, the assigned mileages are: (2h – 30 km), (4h – 40 km), (6h – 50 km), (8h – 60 km), (12h – 75 km), (1d – 100 km), (3d – 285 km), (5d – 450 km). If the Lessee exceeds the included mileage, an additional charge will apply for each extra kilometer, with a cost ranging from 3€ to 12€, depending on the model of the rented vehicle.
2.2.1 Vehicle Delivery and Return
The vehicle will be delivered to the Lessee with a full fuel tank and must be returned in the same condition. It is mandatory to use 98-octane unleaded gasoline, preferably from Repsol or Cepsa service stations. If the vehicle is returned with an incomplete fuel tank, a penalty of 150€ will be applied.
Using improper fuel will incur a penalty of 500€, in addition to any additional costs for damages caused to the vehicle.
The vehicle must be returned at the location, date, and time specified in the contract. A delay exceeding 15 minutes from the agreed return time will result in an additional charge for each extra hour, ranging from 130€ to 240€, depending on the model of the rented vehicle.
2.3 Circuit Experiences
The Lessee must be at least 18 years old. Wearing a safety helmet is mandatory throughout the activity, and it will be provided by the Lessor.
During the activity, a bilingual professional instructor will accompany the Lessee in the front seat, providing assistance and guidance at all times. Following the instructor’s instructions is essential; failure to comply will result in the immediate termination of the activity and a penalty of 100€.
The Lessee is responsible for traveling to the activity location and arriving punctually at the scheduled time. The Lessor has a designated time slot at the circuit to carry out the activity. If the Lessee arrives late or cannot participate due to the expiration of the allocated time, the Lessor will not be held responsible for the missed activity and will not issue a refund.
The Lessee assumes full responsibility for all damages caused during the circuit activity, including personal injuries, damage to the vehicle, facilities, or circuit staff. In circuit activities, damage costs are not limited to the previously provided security deposit, and the Lessee will be required to cover any additional expenses arising from such damages.
In the event of adverse weather conditions, the activity will be canceled immediately. The Lessor will offer the option to reschedule the activity for another date. If the Lessee chooses not to accept the new date, the full cost of the activity will be refunded.
3. Prohibited Conduct
The lessee is expressly prohibited from engaging in the following behaviors while using the vehicle. Violation of any of these prohibitions may result in penalties, the forfeiture of the full security deposit, and full liability for any damages caused:
– Driving under the influence of alcohol, drugs, or any other intoxicating substances
– Smoking, eating, or drinking inside the vehicle. A penalty of 250€ will apply, in addition to covering the cost of any resulting damages.
– Taking the vehicle onto a circuit. If the vehicle is driven on a circuit without the lessor’s express authorization, the lessee will forfeit the full deposit and be liable for all damages, including the full replacement cost of the vehicle in case of total loss. Additionally, a per-kilometer fee for circuit use, as determined by the circuit’s specific rates, will apply, differing from the standard rental kilometer charges.
– Allowing third parties to drive the vehicle, subleasing it, or using it to transport passengers in exchange for compensation.
– Participating in races, competitions, or any type of testing with the vehicle.
– Transporting live animals, except for domestic pets with the Lessor’s express authorization.
– Carrying flammable, hazardous, toxic, corrosive, radioactive, or any other harmful substances that may endanger the vehicle or its occupants.
– Driving on unpaved or poorly maintained roads that could damage the tires, wheels, or undercarriage of the vehicle.
– Exceeding the maximum authorized weight limit of 3,500 kg.
– Deactivating traction control or any other electronic assistance features without the Lessor’s authorization.
– Modifying, applying decals, or painting the vehicle without the prior consent of the lessor. The lessee will bear all costs to restore the vehicle to its original condition if modifications are made without authorization.
– Driving with inappropriate clothing or footwear that may compromise vehicle control. It is prohibited to drive without a shirt, in swimwear, flip-flops, high heels, or any footwear that limits proper pedal control. The Lessee must wear comfortable, flat-soled shoes to ensure safe handling of the vehicle.
4. Vehicle Insurance and Damage Conditions
All vehicles provided by the Lessor are insured, covering personal injury to the Lessee and material damage to third parties in the event of an accident involving the vehicle.
Upon receiving the vehicle, the Lessee must inspect its condition and ensure it matches the description in the delivery document. Any visible defects not recorded must be reported immediately to a member of the Lessor’s staff so that a joint inspection can be conducted and any issues properly documented.
The insurance payment for the Barcelona City Tours, Road Routes, and Experience Packs options covers general vehicle damage. However, damages to side mirrors, windows, tires, and rims are excluded. The Lessee will be fully responsible for the repair costs for these components if damaged. These costs will be added to the final activity price according to the following rates:
– Rims: Damage up to 30 mm: 400€ + VAT to 750€ + VAT. Damage exceeding 30 mm: 3,000€ + VAT.
– Tires: 1,000€ + VAT each.
– Scratches on the bodywork: 1,500€ + VAT per scratch.
– Broken bodywork parts: 5,000€ + VAT per part.
– Side mirrors and windows: 4,500€ + VAT per unit.
* The insurance does not provide coverage for lost luggage or for damage to the vehicle resulting from theft, vandalism, or traffic accidents.
5. Payment Policy
5.1 Payment Conditions
The rental agreement rate includes the base rental price, the agreed duration, any selected additional services, applicable taxes or fees, and any extra charges for vehicle damage, refueling, mileage overages, or late returns, as detailed in Sections 2 and 4 of this document.
Payments can be made via credit card or cash, and all billing will be exclusively in euros. If the Lessor cannot process currency conversion or the cardholder’s bank declines the transaction, the payment will be made in the rental currency, and its conversion will subsequently be handled according to the cardholder’s bank policies.
The Lessee must settle any outstanding amounts by the due date specified on the invoice. Late payments will incur interest charges as outlined in the invoice terms.
Rates for rental services, additional services, optional coverages, or insurance are calculated based on the rates applicable at the time of booking. If no prior reservation or special rate agreement exists, the rates in effect at the time of signing the rental agreement will apply.
5.2 Fines and Penalties
The Lessee is responsible for paying any fines incurred during the rental period, as well as associated administrative fees, which include:
– Fine processing fee: 70€ + VAT.
– Damage claim processing fee: 100€ + VAT.
– Roadside assistance management fee: 150€ + VAT.
5.3 Cancellations, Refunds, and Changes
To confirm a reservation for an experience or a specific vehicle rental, the Lessee must pay 30% of the total service amount in advance. Refund percentages for cancellations depend on the notice provided:
– 15 days or more in advance: 100% refund of the reservation amount.
– 7 to 14 days in advance: 60% refund of the reservation amount.
– Less than 7 days in advance: 30% refund of the reservation amount.
– Same-day cancellations or no-shows: No refund.
* All refunds are subject to the deduction of administrative fees, which will be the Lessee’s responsibility.
Security deposits or credit card holds will be released or refunded after the activity is completed and the vehicle has been inspected by the Lessor’s staff, provided no damages are found. For hourly or daily rentals, deposit refunds will be processed within 24 to 48 hours of vehicle return.
Reservation changes can be requested up to 7 days before the scheduled experience. Requests made with less notice may incur an additional administrative fee. Any costs associated with bank transfers will be fully borne by the Lessee.
6. Third-Party Activities
The Lessor collaborates with various specialized providers offering luxury activities in Barcelona. Experiences included in the Experience Packs, such as helicopter rides, catamaran cruises, or jet ski activities, are managed by third parties. As such, the Lessor assumes responsibility only for the driving experience and is not liable for any changes, unforeseen events, or deficiencies in the services provided by these third-party vendors.
These activities are conducted in locations separate from the driving experience. It is the Lessee’s responsibility to ensure timely arrival at the activities organized by third parties. While the Lessor will make every effort to facilitate on-time arrivals, it cannot be held responsible for missed activities due to delays.
Reservations for third-party activities are subject to the specific terms and conditions of each provider. For helicopter flight activities, a valid copy of a passport or NIE must be presented. Without this documentation, participation in the flight will not be permitted.
7. Gift Cards
Gift cards are non-refundable and cannot be exchanged for cash. They can only be used to enjoy our experiences.
Gift cards are valid for any driving experience and expire one year after the date of purchase.
Gift cards only apply to the experience value not to extras like insurance, passenger or video.
If a booking is made for a vehicle or experience that costs less than the card value, the gift card has no residual value.
